Abuse/Ill-treatment case referral form

Litigating the Right of People with Mental Disabilities to be Free from Abuse/ Ill-treatment MDAC is a non-governmental organisation whose vision is a world of equality where emotional, mental and learning differences are valued equally where the inherent autonomy and dignity of each person is fully respected and where human rights are realised for all persons without discrimination of any form. Since 2002, MDAC has litigated cases to demand respect for the rights of people with mental disabilities and redress for violations. Right now we are litigating cases of abuse/ill-treatment committed against people with mental disabilities in five countries in Central and Eastern Europe and Africa. We are currently seeking to advance the right of persons with mental disabilities be free from abuse/ill-treatment and to receive redress for such violations through identifying strategic cases for litigation at the national, regional and/or international level in the following countries Bulgaria 6. Slovenia Some examples of types of acts we seek to litigate include Sexual or gender-based violence (SGBV) rape, forced abortion, sterilisation or other forms of SGBV Extreme physical neglect Extreme emotional neglect extreme lack of interaction/stimulation Medical neglect denial of necessary medical treatment or of reasonable accommodation Forced medication with psychotropic medications Other forms of forced treatment or where consent to treatment is given by a third party Chemical restraint use or over-use of sedatives Physical restraint strapping, chaining, use of cage or net beds, tying of hands and feet) Solitary confinement Psychological abuse threats to life or safety Violence such as hitting or beating by staff of psychiatric facilities or social care homes, caregivers, family members, traditional healers Un-modified electro-convulsive therapy (ECT) Severe overcrowding Branding, cutting or forcible tattooing. Cases may challenge the lack of an effective remedy for these violations or the lack of an independent monitoring mechanism or ineffective exercise of a monitoring mandate by designated mechanisms. Cases where the above has occurred will nevertheless not be considered for litigation by MDAC if The harm caused by the acts does not reach a level of severe mental or physical suffering sufficient to be defined as torture or ill-treatment They are not intentionally carried out or omitted to be carried out (although intent can be implied when the acts are based on discrimination) The State is neither directly nor indirectly involved and/or They are not explicitly or implicitly carried out for purposes other than purely and genuinely therapeutic purposes. Severity of the pain and suffering may range from short-term but intense physical pain to permanent physical deformity, death or severe mental suffering but should be provable and directly linked to the torture or ill-treatment.
