LITI-GATE

With LITI-GATE we aim to promote the enforcement of the EU Charter of Fundamental Rights through strategic litigation. In particular, we aim to address breaches of the fundamental rights of persons with intellectual and/or psychosocial disabilities across the European Union and to ensure that their rights are mainstreamed both at the European Union level as well as at the level of the Member States.

The LITI-GATE project – Strategic Litigation as a Gateway to address the rights of Persons with Disabilities in the European Union – brings together 6 partners from 5 countries.  The aim of the project is promote the enforcement of the EU Charter of Fundamental Rights through strategic litigation. We focus specifically on addressing breaches of the fundamental rights of persons with intellectual and/or psychosocial disabilities across the European Union and to ensure that their rights are mainstreamed both at the European Union level as well as at the level of the Member States. 

The two-year project is implemented between 2023 September and 2025 August in 5 EU countries: Bulgaria, Czechia, Hungary, Romania, and Slovakia The project consortium includes:  

“Yes, there is a tool called individual assessment. […] there is no one to make it work because whoever has to do the individual assessment does not know what they are doing.”

Our Objectives

  • Improve knowledge on how to conduct strategic litigation for the benefit of persons with disabilities. 
  • Develop practical guidance on using the EU Charter of Fundamental Rights for strategic litigation. 
  • Build capacity of national and regional stakeholders on conducting strategic litigation. 
  • Strengthen cooperation between national and regional organisations of persons with disabilities (OPDs), victim support organisations and relevant EU networks to enforce the Charter for persons with disabilities who experiencefundamental rights breaches. 

Our Methodology

  • Conducting research on strategic litigation at the national level. 
  • Developing a Strategic Litigation Guidebook based on EU and national laws. 
  • Designing and delivering training sessions for persons with disabilities, organisations of persons with disabilities (OPDs) and other legal professionals.  
  • Organising webinars and small group sessions to identify issues that persons with disabilities are facing and design legal strategies for remedying potential rights infringements.  
  • Producing an educational podcast series on strategic litigation for persons with disabilities. 

Strategic litigation can contribute to ensuring that the human rights approach to disability is adopted in the interpretation of EU Charter of Fundamental Rights.
